Plan4Event - Terms & Conditions

User Content License and Rights

Without this license, Plan4Event would be unable to provide the Plan4Event or its publications. For example, the license you grant to Plan4Event is non-exclusive (meaning you are free to license your content to anyone else in addition to Plan4Event), fully-paid and royalty-free (meaning that Plan4Event is not required to pay you for the use of the User Content that you post), sublicensable (so that Plan4Event can use its affiliates and subcontractors such as Internet content delivery networks to provide Plan4Event), and worldwide (because the Internet and Plan4Event's reach are global).

This license will terminate at the time you remove your User Content from the Plan4Event Services except for any User Content that Plan4Event has sublicensed prior to your removal of the User Content from the Plan4Event Services, which license shall continue forever. To remove User Content, please send a request to info@plan4event.in and include a brief description of the item(s) to be removed along with the URL of the current location of the item(s) on the Plan4Event Website. We will remove the item(s) as soon as possible. If Plan4Event uses the Vendor's content on its Website, it shall do so while giving credit to the Vendor.

Plan4Event does not assume the obligation to ensure the protection of the content posted on the Plan4Event Website/Platform. If the Vendor posts content on the Website and the same is infringed by any other Vendor or any other third party, it shall not be the liability of Plan4Event. We attempt to prevent such copying and infringement by putting our watermark on each image, but assume no further responsibility for securing the content.

Plan4Event Content and Third-Party Content

The Plan4Event Services contain content owned by Plan4Event ("Plan4Event Content"). Plan4Event Content is protected by copyright, trademark, patent, trade secret, and other laws, and Plan4Event owns and retains all rights in the Plan4Event Content and the Plan4Event Services.

Plan4Event hereby grants you a limited, revocable, non-sublicensable license to view the Plan4Event Content (excluding any software code) solely for your personal use in connection with viewing the Plan4Event Website and using the Plan4Event Services. Without limiting the generality of the foregoing, you agree that you shall not copy, modify, translate, publish, transmit, license, sublicense, assign, distribute, perform, display, or sell any Plan4Event Content appearing on or through the Plan4Event Services.

The Plan4Event Services contain content of other Users and other Plan4Event licensors ("Third Party Content") and you are permitted to access such content solely for your personal use in connection with viewing the Plan4Event Website and using the Plan4Event Services.

Without limiting the generality of the foregoing, you agree that you shall not copy, modify, translate, publish, transmit, license, sublicense, assign, distribute, perform, display, or sell any Third Party Content appearing on or through the Plan4Event Services. If a User is found to be infringing the intellectual property or any other right of any other person in any manner, they shall be solely liable, and no liability shall be placed on Plan4Event for the same.

Prohibited Content

Plan4Event reserves the right, in its sole and absolute discretion, to determine whether User Content is appropriate and to remove any User Content without prior notice or liability to you, which it deems inappropriate. Without limiting the generality of the foregoing, the following is a partial list of the types of User Content that Plan4Event deems inappropriate:

• Content that criticizes a business or individual beyond offering a mere opinion.
• Content that harasses or advocates harassment of another person.
• Content that exploits people in a sexual or violent manner.
• Content that contains nudity, violence, or offensive subject matter or contains a link to an adult website.
• Content that includes racial, ethical, or otherwise objectionable language.
• Content that is defamatory, libelous, or otherwise tortious language.
• Content that solicits personal information from anyone under 18.
• Content that promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous.
• Content that promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files.
• Content that involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming."
• Content that contains restricted or password-only access pages or hidden pages or images (those not linked to or from another accessible page).
• Content that furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.
• Content that solicits passwords or personal identifying information from other Users for commercial or unlawful purposes.
• Content that is owned by, created by, or related to a third party and the entity posting/publishing such content has no right to do so.
• Content that includes commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.

Prohibited Activity

You expressly agree that you are prohibited from engaging in the following Prohibited Activities in connection with your use of the Plan4Event Services, and you agree that you will not engage in them:

• Copying, modifying, translating, publishing, transmitting, licensing, sublicensing, assigning, distributing, performing, publicly displaying, or selling any Third Party Content or Plan4Event Content appearing on or through the Plan4Event Services.
• Criminal or tortious activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets.
• Covering or obscuring the banner advertisements on your personal profile page or any Plan4Event page via HTML/CSS or any other means.
• Any automated use of the system, such as using scripts to add friends or send comments or messages.
• Interfering with, disrupting, or creating an undue burden on the Plan4Event Services or the networks or services connected to the Plan4Event Services.
• Attempting to impersonate another User, person, or representative of Plan4Event.
• Using the account, username, or password of another User at any time or disclosing your password to any third party or permitting any third party to access your account.
• Selling or otherwise transferring your profile without our permission.
• Using any information obtained from the Plan4Event Services in order to harass, abuse, or harm another person.
• Displaying an advertisement on your profile, or accepting anything of value from a third person in exchange for performing any commercial activity on or through the Plan4Event Services on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins for a commercial purpose, or sending private messages for a commercial purpose.
• Using the Plan4Event Services in a manner inconsistent with any and all applicable laws and regulations.

Copyright Policy

You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to Plan4Event or others (including without limitation Third Party Content or Plan4Event Content) without obtaining the prior written consent of the owner of such copyrighted material, trademarks, or other proprietary information.

As Plan4Event is a content-heavy platform, owing to the content generated by Plan4Event as well as its numerous Vendors and Customers, Plan4Event takes copyright and intellectual property/proprietary rights extremely seriously.

It is our policy to take reasonable steps within our power to terminate any User who is found to be a repeat infringer of copyright. Without limiting the foregoing, if you believe that your work has been copied and posted on the Plan4Event Services in a way that constitutes copyright infringement, please provide us with the relevant proof and we will be happy to take corrective action accordingly.

Customers

Users acknowledge and agree that they are visiting the Plan4Event Platform solely to gather information about a Vendor, and the booking for the same is done in person, separately from Plan4Event. Therefore, they shall not hold Plan4Event liable in any manner for any issues that may arise in the future pertaining to such Vendor or such booking.

The Customer acknowledges and agrees that all transactions happen between the Users and that Plan4Event is not involved in the same in any manner.

If a Customer shares their content and photographs with Plan4Event for display on our platform, such content and photographs shall be the Customer’s and, once shared with Plan4Event, shall be deemed available for reuse and reposting by Plan4Event.

Plan4Event shall make all efforts to ensure that the Customer’s experience is smooth and seamless, without any hassles, but takes no liability or responsibility to ensure the same.

Vendors

Each Vendor acknowledges that they are merely listed on the Plan4Event platform, through which they get access to their target clientele. Each Vendor creates their profile on the Plan4Event Platform and ensures that the information provided in relation to such profile is true. Any misrepresentation of their identity or work shall be their sole responsibility and not Plan4Event’s.

Vendors acknowledge and agree that they are independently transacting and providing services with the Customers and Plan4Event is not involved in any manner, except for being a listing platform. However, Plan4Event expects the Vendors to maintain the quality of service and not misrepresent anything in any manner.

Vendors shall not use any third-party photographs or content and represent them as their own. Any such misrepresentation shall be the sole liability of the Vendor.

As an Event Aggregator, Plan4Event has commercial dealings with certain Vendors on its platform. This commercial arrangement includes, but is not limited to, providing additional visibility in return for certain charges.

This charge in no manner guarantees any business confirmation/booking. Plan4Event acts as a facilitator, helping the Vendors leverage its massive network and enabling them to reach more clients.

Reviews on Vendor Profiles

Reviews written on Vendor's Plan4Event profile are a very critical tool for both Customers and Vendors. We therefore take extreme care to maintain the integrity and reliability of reviews on our platform.

You can report a review as false to Plan4Event for verification at reviews@plan4event.in or info@plan4event.in.

The Plan4Event team will contact the Vendor within 48 hours and ask them to submit the aforementioned proof for the review. If the Vendor fails to submit proof within 7 days of being contacted, the verification case will be closed.

• a) If Plan4Event receives reasonable and satisfactory proof — the review will be removed from the Vendor profile within 1 week, after informing the Vendor and the reviewer.

Note that Plan4Event cannot and does not verify and affirm every statement in the reviews written on Vendor profiles. However, we maintain a reasonable verification process for reported reviews to ensure that reviews on Plan4Event are posted by genuine Customers of the Vendors and that they adhere to our terms.

Plan4Event reserves the right to disable a reviewer’s review who has not hired the vendor through Plan4Event’s involvement, for any reason. Plan4Event has the sole discretion to decide whether to further investigate reported reviews or not.

Plan4Event prides itself on ensuring authentic and genuine reviews that can help engaged couples make better hiring decisions. As a platform committed to displaying honest reviews, we request our vendors to adhere to the following guidelines.

The Vendor can ask their clients to review their profile on Plan4Event and share their profile link with them and ask them to write a review, or, simply ask them to share their review and rating at info@plan4event.in and we will get the review uploaded on their behalf.

The best way to get positive reviews is by delighting your clients. Selective solicitation is strictly prohibited. Giving out any form of compensation, getting your family/relatives/team members to write a review for you is absolutely unacceptable, and such reviews will be removed without any notice.

Whether you agree with the feedback or not, we advise you to take the criticism in good spirit. In cases of negative reviews, we strongly suggest that you respond to the review with your side of the story as it shows that you care. From our statistics, we have seen that users read both sides of the story and take an unbiased decision while reading reviews.

Some of the most popular and booked vendors on Plan4Event have also received negative reviews on their profiles, so you don't need to worry. Another way to minimize the impact would be to get more positive reviews on your profile so that the negative review gets pushed down and your average rating improves.

Deletion of Profile of Vendor

Plan4Event does not allow or facilitate the account deletion of Vendors once created. The account may be marked as Unclaimed upon the request of the vendor at the platform's discretion and cannot be searched on the platform.

Please note, a Vendor's profile may be created even without their prior consent. One way this happens is when Users submit reviews of Vendors who do not yet have an active, listed profile on Plan4Event.

As a trusted aggregator of event information and data, Plan4Event displays this information; however, in an Unclaimed/Unverified status due to the absence of full details.

Third Party Campaigns and Adherence to their T&Cs

Merchants/Vendors registered on Plan4Event acknowledge and understand that any products you purchase on or through any third-party platform through a partnership with Plan4Event shall be made solely as per the applicable terms and conditions of such platform.

For example, Plan4Event has a collaboration with Nykaa, as part of which beauty professionals are enrolled in programs like Nykaa Pro. You may avail of certain sign-up benefits/discounts applicable to professionals having an association with Plan4Event.

However, you acknowledge that the purchases made on such platforms are solely for the purpose of being able to render services to the clients/end users. You shall ensure that you purchase all products only for the purpose of providing services to the end users and not for any other purpose in any manner.

User Disputes

You are solely responsible for your interactions with other Plan4Event Users (including Vendors). Plan4Event reserves the right, but has no obligation, to monitor disputes, and to terminate the privileges of any User at any time, for any or no reason.

Plan4Event is merely a listing and aggregating platform, and any engagement, interaction, or booking that happens on the Plan4Event platform is not the responsibility of Plan4Event.

The Vendor data displayed on the profiles, such as photos, price, reviews, etc., is a result of input from the Vendors and their customers. While Plan4Event makes efforts to verify the claims made in terms of price, work, etc., it does not guarantee or ensure the displayed information to be accurate in any manner.

Privacy

Use of the Plan4Event Services is also governed by our Privacy Policy, located at plan4event.in/privacy and incorporated into this Agreement by reference.

Promotions and Giveaways

From time to time, Plan4Event will offer sweepstakes, promotions, or giveaways on behalf of third parties. Each promotion or giveaway will have its own terms that will identify what information is gathered, how that information is used, and with whom that information is shared.

Plan4Event encourages you to review such information before engaging with each sweepstake, promotion, or giveaway, and assumes no liability for the same.

Disclaimer of Warranties

The Plan4Event Service is provided to you on an "AS IS" and "AS AVAILABLE" basis without representations or warranties of any kind and Plan4Event expressly disclaims, to the fullest extent permitted by applicable law, any and all implied or statutory warranties, including, without limitation, the implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose.

No advice or information, whether oral or written, obtained by you from the website or Plan4Event Services shall create any warranty not expressly stated in these Terms of Use. With the purchase of any product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

Without limiting the generality of the foregoing, Plan4Event is not responsible for any incorrect or inaccurate content posted on the Plan4Event Website or in connection with the Plan4Event Services. User Content created and posted on the Plan4Event Website may contain links to other websites. Plan4Event is not responsible for the accuracy or opinions contained in User Content or on third-party websites linked from User Content.

Plan4Event is not responsible for the safety of third-party websites, and any such websites accessed by the User are their sole responsibility. Such websites are not investigated, monitored, or checked for accuracy or completeness in any way by Plan4Event. Inclusion of any linked website on the Plan4Event Services does not imply approval or endorsement of the linked website by Plan4Event. When you access these third-party sites, you do so at your own risk.

Plan4Event assumes no responsibility for any third-party advertisements posted on this Plan4Event Website or through the Plan4Event Services, nor does it take any responsibility for the goods or services provided by its advertisers. Plan4Event is not responsible for the conduct of any User of the Plan4Event Services, whether online or offline.

Plan4Event assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft, or destruction or unauthorized access to or alteration of any User communication or any content.

Plan4Event is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, or software, failure of any email or players due to technical problems or traffic congestion on the Internet or on any of the Plan4Event Services or combination thereof, including injury or damage to Users or to any person's computer related to or resulting from participating or downloading materials in connection with the Plan4Event Services.

Under no circumstances will Plan4Event be responsible for any loss or damage, including personal injury or death, resulting from use of the Plan4Event Services, attendance at a Plan4Event event, from any content posted on or through the Plan4Event Services, or from the conduct of any Users of the Plan4Event Services, whether online or offline.

Plan4Event cannot guarantee and does not promise any specific results from the use of the Plan4Event Services.

Limitation of Liability

IN NO EVENT WILL PLAN4EVENT OR ANY PARENT, SUBSIDIARY, AFFILIATE, DIRECTOR, OFFICER, EMPLOYEE, LICENSOR, DISTRIBUTOR, SUPPLIER, AGENT, RESELLER, OWNER, OR OPERATOR OF PLAN4EVENT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF PLAN4EVENT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, PLAN4EVENT'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT, IF ANY, PAID BY YOU TO PLAN4EVENT FOR THE PLAN4EVENT SERVICES DURING THE TERM OF YOUR USE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

YOU SPECIFICALLY ACKNOWLEDGE THAT PLAN4EVENT SHALL NOT BE LIABLE FOR USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE LIMITATIONS MAY NOT APPLY TO YOU.

Special Admonitions for International Use

Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from India, the United States, or the country in which you reside.

Disputes; Choice of Law; Venue

If there is any dispute about or involving the Plan4Event Services, you agree that the dispute shall be governed by the laws of Hyderabad, India, and the courts of Hyderabad or New Delhi shall have jurisdiction. The prevailing party in any action brought in connection with this Agreement shall be entitled to an award of attorneys' fees and costs incurred by the prevailing party in connection with such action.

Indemnity

You agree to indemnify and hold Plan4Event, and any parent, subsidiary, and affiliate, director, officer, employee, licensor, distributor, supplier, agent, reseller, owner, and operator, harmless from and against any and all claims, damages, liabilities, losses, costs, or debts, including but not limited to reasonable attorney's fees, arising out of or resulting from:

• (i) Your use of and access to the Plan4Event Website;
• (ii) Your violation of any term of these Terms of Use;
• (iii) Your violation of any third-party right, including without limitation any copyright, property, or privacy right;
• (iv) Any claim that your User Content caused damage to a third party.

This defense and indemnification obligation will survive these Terms of Use and your use of the Plan4Event Website and/or Plan4Event Services.

Waiver and Severability of Terms

The failure of Plan4Event to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

Statute of Limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
